What is an AUP?
It is a statement by NightSky Hosting (NSH) as to what is acceptable to use our servers for. Any breach of this AUP by a user or users is at their own risk, and may be subject to termination without repayment plus criminal or civil court proceedings.
Who is responsible?
NightSky Hosting is not responsible for the content on our servers placed by account holders or their assigns. If NSH finds that any content on our servers is illegal, we may, at our option, remove the items in question without warning and seek remedies if needed in court.
What content is acceptable?
Any content that is not illegal under any US or California statue, or does not infringe on a copyright including video, audio, or software may be placed on our servers. It is the account holders is responsiblity for determining if any data is illegal or infringes on copyrights.
What if NSH finds out some content is illegal, or under copyright?
NSH will remove access to those files and inform the account holder of infringement. If the authority reporting is a legal authority, NSH will comply with the legal authority. If the account holder has an issue with the complaint levied against them, it is the sole responsibility of the account holder to clear up any infractions.
What about e-mail?
NSH will not allow its servers to be used for mass e-mailings to unknowing users. NSH strictly prohibits the sending of Unsolicited commercial email, or spam, from any account holder. Reguardless of if the emails originagte from our servers, or the advertised site is hosted on our servers, any account holder using his account for spam will be immediately removed from NSH's servers. There are no refunds for any closed account.
